Conciliation system inside commercial courts has been facilitated to help provide alternative dispute resolution (ADR) and preserve rights, according to the Saudi Ministry of Justice (MoJ). The system helps commercial parties to settle disputes out of court through conciliation and mediation.
“The conciliation procedures are clear and straightforward,” says the ministry. “It starts with filing a conciliation application through the Taradhi conciliation platform, the Najiz portal, or courts. The application is registered and given a reference number, and the parties are notified of the session date and location. “The sessions are held either remotely or at the premises of the Conciliation Center,” explained the ministry.
According to the ministry, the conciliation session can be attended by the case parties and/or their legal representatives under valid powers of attorney. “To protect privacy and confidentiality, any other people must sign a non-disclosure agreement and must comply with session rules and regulations.
“The conciliation path saves case parties a lot of time and cost. The process takes around 45 days from the time of application, and streamlines ADR solutions for the parties,” concluded the ministry.
